Revised Code of Washington 46.61.502 defines DUI as driving a motor vehicle with a BAC over .08 within two hours of driving, a THC concentration of 5.00 or higher within two hours of driving and/or while “under the influence” or “affected by” alcohol, marijuana, any drug or any combination of these three. It is a defense to DUI if you consumed the alcohol/marijuana/drugs after the driving was complete.

Prepare for the Cost.
A good attorney is probably $5,000.00 to $12,000.00 and that is not your only likely expense. You will also need an alcohol and/or drug evaluation and that will cost $150.00 to $1,000.00. The Alcohol Drug Information School is the lowest level of treatment and that is about $50.00 to $150.00. Any higher level of treatment for alcohol and drug abuse could be as much as a few thousand dollars. The victim impact panel will also be required and is $25.00 to $50.00. Court fees/fines (if you are convicted of something) will be approximately $500.00 to $2,500.00 (possibly more depending on what you are convicted of). Probation, if it is ordered, is about $50.00 a month. You will probably have to pay for 12 to 60 months of probation and you will have to pay for it up-front. Try to remember, five or ten years from now, you will forget how much this cost you. You will only remember if you achieved a favorable result.
